1.  Registration on Trackpads.com is free! We do insist that you abide by the rules and policies detailed below and on other areas of the site as indicated. 2.  A valid email address is required to complete registration on the site! If you do not use a valid email your registration/activation email will not be delivered and you will not be able to complete the registration process.

3.  We require your date of birth only during registration and afterwards is your discretion to show on the forums or not. This helps us ensure that you are aware of the age restrictions of the site and nothing more.

4.  Minimum age to register and participate on Trackpads.com is 16.  If you are under 16 and wish to participate you must have your parents permission to register.  Once complete please have your parents contact the staff at webmaster@trackpads.com before you sign in.  Failure to comply will result in immediate account removal/banning.

5.  Immediately after registration you will receive a welcome message and email explaining more about the community and what we have to offer!

I. Welcome to Trackpads.com!

Trackpads.com strongly believes in people communication and in the freedom of expression as long as legal or moral accepted standards are not crossed. In this Web site, Trackpads.com is offering you several services and software products that may expand your communication facilities.

Trackpads.com trusts that you will use these facilities to promote the flowing exchange of information and exercise your freedom of expression in accordance with this policy. User violation of this Policy may result, among other things, in the suspension or cancellation of User's access to the Trackpads.com network, system, software, servers, various directories and listings, various message and news boards, tools, information and databases.

It is important that you read and understand this agreement before you participate on the Trackpads.com website or any of its sub sites. If you do not understand something or have any questions at all please contact us for clarification before you subscribe or use our services. By registering for membership or using any of the Trackpads.com services you are stating that you agree and are bound to this agreement.

If this agreement gives you a headache then be comforted in that fact that it gave us a migraine writing it. I think we can all blame trial lawyers for our mutual headaches, unless you are a trial lawyer which in that case I am very, very sorry if I offended you.


II. Privacy Policy

The Trackpads.com are not directed to children under the age of 16. Trackpads.com prohibits registration by, and will not knowingly collect personally identifiable information from, anyone under 16. This requirement will be posted at points of data collection within the Trackpads.com, such as registration for services.

We also urge parents to instruct their children never to give out their real names, addresses or phone numbers without parental permission when using the Internet.

Information Collection, Storage and Use:

We refer to information that identifies an individual as "Personal Information". In general, Trackpads.com collects Personal Information from users of the Trackpads.com in connection with access to certain online areas or services, including but not limited to during (i) registration for certain online community services and tools such as message boards, chat rooms or other community services; (ii) registration for special communications, such as email updates and newsletters; (iii) subscription registration; (iv) user surveys; (v) events, sweepstakes, contests or promotions; and (vi) registration for online multi- or single-player gaming, either through the Trackpads.com or through the game itself. We do not use any of this navigational data about where you "as an individual user " go on Trackpads.com or share any of this data with third parties. This information is not archived and is only used to determine which software requires updating. Trackpads.com may record audio conversations or copy text chat or video images from chat rooms on the Trackpads.com and may disclose such material for use in connection with promoting the Trackpads.com.

I. Sites You Visit. As you browse around the Trackpads.com, we may store information about which pages you visit and other information presented in your browser's URL address line. Trackpads.com will use this information to help determine what our users are most interested in.

J. Merger or Acquisition. Account Removal and Deletion:

You may request that your account be deleted at any time by contacting us using the information provided below. Please understand that your personal contact information will be removed from your account but under the rules of our Terms of Service, information you submitted to Trackpads.com will remain in the database. Account deletion will ony remove personal information such as real name, email address, passwords and other identifying information that you provided in your Trackpads.com profile. Information you posted on the various Trackpads.com services such as message board postings, blogs etc will not be removed.


III. Trackpads.com’s Content & Acceptable Use

Trackpads.com does not actively monitor nor does it exercise any editorial control over the content of any Web site, message or other material or information created, obtained or accessible through the Trackpads.com Services and Information. However, Trackpads.com reserves the right to remove any material it becomes aware of that is in its sole discretion, potentially illegal, could subject Trackpads.com to liability, violate this Policy or is otherwise found inappropriate.

You agree not to post any message containing, or otherwise use, any obscene or offensive language or post anywhere else on or through the Trackpads.com Services and Information any material that is an invitation to fast money making schemes, defamatory, racial, abusive or hateful, may constitute junk mail, unauthorized advertising or harassment, invades anyone's privacy, or encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national or international law or regulation. You agree to use the Trackpads.com Services and Information for private personal use only and refrain from any use for unlawful purposes.

You are solely responsible for ensuring that any material or information you post anywhere on or through the Trackpads.com Services and Information - including but not limited to text, photographs, and sound - does not violate the copyright, trademark, trade secret, or any other personal or proprietary rights of any third party or is posted with the permission of the owner(s) of such rights.

You agree not to disrupt or interfere with the Trackpads.com Services and Information or any other services provided on this Site, nor to alter or tamper with any information or materials on or associated thereto.

You agree not to attempt to penetrate security measures of Trackpads.com, whether or not the intrusion results in corruption or loss of data.

The access to Trackpads.com's various directories, databases and listings is provided by Trackpads.com as a convenience. Trackpads.com users and those wishing to contact Trackpads.com users are granted limited access to Trackpads.com's various directories, databases and listings solely for the purpose of allowing more convenient personal communications over the Trackpads.com system and products. Any other use or attempt to use Trackpads.com's various directories, databases and listings for commercial, or other purposes or for systematic retrieval of data and information stored in Trackpads.com's various directories, databases and listings and any kind of copying or reproduction of the data, or any part thereof, stored in Trackpads.com's various directories, databases and listings to any other location or server for further reproduction or distribution is strongly prohibited.

You acknowledge that you are expressly prohibited from utilizing the Trackpads.com Forums, servers, software nor any of the Trackpads.com Services and Information in connection with data mining of any kind, commercial use, the sending of unsolicited electronic mail or other forms of messages, whether commercial or not, to a large number of recipients. This prohibition extends to the sending of unsolicited mass mailings from another service which in any way implicates the use of the Trackpads.com's various directories, databases and listings.

A message is unsolicited if it is sent to a recipient who has not requested or invited the message. Mass mailing is mailing of messages in quantities exceeding reasonable personal use. For purposes of this provision, merely making one's e-mail address accessible to the public shall not constitute a request or invitation to receive messages.

You agree to refrain from revealing your password to others or allowing others to use your Trackpads.com account (other than authorized users in your household).

You agree to refrain from forging any message header, in part or whole, of any electronic transmission, originating or passing through the Trackpads.com environment, distributing viruses to, from or through the Trackpads.com Services and Information and allowing access to the Trackpads.com servers through your account for the purpose of operating a server of any type or for any other purpose which is not common personal use.

You agree to refrain from revealing any trade secret or other internal business communications of Trackpads.com or its subsidiary websites. This includes any communication with employees or volunteers of Trackpads.com.

You agree to refrain from posting or uploading any information that is classified as SECRET, TOP SECRET or any information for which you do not have the authority to release publicly. Information that has been declassified by the US Government can be posted on the site with no restriction. You agree to be held solely responsible for any inappropriate disclosure of sensitive information resulting from your personal actions.


IV. Copyrights, Trademarks, Trade secrets & Patents

Trackpads.com respects the intellectual property of others, and we ask our users to do the same. Trackpads.com may, in appropriate circumstances and at its discretion, disable and/or terminate the accounts of users who may be repeat infringers. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide Trackpads.com’s Copyright Agent the following information:

1. an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;

2. a description of the copyrighted work or other intellectual property that you claim has been infringed;

3. a description of where the material that you claim is infringing is located on the site;

4. your address, telephone number, and email address;

5. a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

6. a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.

V. Legal Indemnity

IT IS SOLELY YOUR RESPONSIBILITY TO EVALUATE THE QUALITY, ADEQUACY, ACCURACY, COMPLETENESS, CURRENTNESS, VALIDITY AND USEFULNESS OF ALL OPINIONS, ADVICE, SERVICES, AND OTHER INFORMATION OBTAINED OR ACCESSIBLE THROUGH THE TRACKPADS.COM SERVICES AND INFORMATION.

You agree to indemnify Trackpads.com, its employees, agents, and representatives, and to hold them harmless, from any and all losses, claims and liabilities (including attorneys fees) which may arise from your submissions, posting of information or deletion thereof, from your use of any of the Trackpads.com Services and Information or any other service and/or material obtained from or accessible through any services provided on this Site, or from your breach of these rules or any other agreement between you and Trackpads.com. You further agree that Trackpads.com is not responsible, and shall have no liability to you or anyone else, for any material posted by others, including defamatory, offensive, or illicit material, and that the risk of damage from such material rests entirely with you.

Trackpads.com has no practical ability to restrict all conduct, communications or content which might violate this Policy prior to its transmission on or through the Trackpads.com Services and Information, nor can Trackpads.com ensure prompt removal of any such communications or content after transmission or posting. Accordingly, Trackpads.com does not assume liability to users or others for any failure to enforce the terms of this Policy.

Trackpads.com is a lawful US Organization with deep military affiliations and as such will comply with any legal subpoena and or cooperate with any US judicial or military intelligence investigation. Cooperation with foreign military or governmental investigations will first be referred to US Judicial Authorities and US Military SAEDA representatives before any cooperation or acknowledgement is given.


VI. Representations, Warranties and Acknowledgements

Trackpads.com does not endorse, and specifically disclaims any responsibility or liability for, any content on any message board or blog, in any chat room, on any Web page, or on any other content on Trackpads.com. Trackpads.com makes no representations about the reliability of services provided by Trackpads.com or by any third party provider, and disclaims all liability in the event of any service failure. You acknowledge that any reliance on said material and/or systems will be at your own risk. Trackpads.com makes no representations regarding the amount of time that forums, chat rooms, blogs, message board discussions, uploaded files, or any other content will be preserved by Trackpads.com.

Trackpads.com reserves the right to add new membership programs and to change the terms of existing membership programs at any time, including paid programs. These modifications may include, but are not limited to, changes in the service, product offerings, price, or administration of the program. Not all products are available for all platforms, clients, or browsers. Trackpads.com will announce any change in the price of the program on its website prior to any such change taking effect.

Without limiting the generality of the previous sentence, you authorize Trackpads.com to include the information you provide in a searchable format that may be accessed by users of Trackpads.com.

You also grant Trackpads.com and its affiliates and related entities the right to use your name and any other information about you that you provide in connection with its use and with the reproduction or distribution of such material, and also grant Trackpads.com the right to use any material, information, ideas, concepts, know-how or techniques contained in any communication you send to us for any purpose whatsoever, including but not limited to developing, manufacturing and marketing products using such information. All rights in this paragraph are granted without the need for additional compensation of any sort to you.

You participate in and/or operate message boards, chat rooms, blogs, and/or other Trackpads.com features at your own risk. If you are unhappy with the contents and/or operation of a message board, blog, and/or chat room, your only recourse is to contact the host of said message board and/or chat room or owner of said blog. If you are dissatisfied with any feature, operability, contents, this agreement, other agreements Trackpads.com imposes as a condition of usage, or any other component of the Trackpads.com Web site, your sole remedy is to discontinue use of Trackpads.com services.

If ordering merchandise and/or services from anyone other than Trackpads.com, through any commercial service offered via an official Trackpads.com partnership or affiliate, via Trackpads.com, all transaction terms including but not limited to purchase terms, payment terms, warranties, guarantees, maintenance, and delivery, are solely between you and the seller of the merchandise or services. Trackpads.com makes no warranties or representations whatsoever with regard to any goods or services provided by the seller of the merchandise or services and shall not be liable for the costs or damages arising, either directly or indirectly, from the products or services or from the actions or inactions of the Seller.

UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL TRACKPADS.COM BE LIABLE FOR ANY INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF OR INABILITY TO USE TRACKPADS.COM NOR SHALL TRACKPADS.COM BE RESPONSIBLE FOR ANY DAMAGES WHATSOEVER THAT RESULT FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF FILES, ERRORS, DEFECTS, DELAYS IN OPERATION OR TRANSMISSION, OR ANY FAILURE OF PERFORMANCE WHETHER OR NOT CAUSED BY EVENTS BEYOND TRACKPADS.COM' REASONABLE CONTROL, INCLUDING BUT NOT LIMITED TO ACTS OF GOD, COMMUNICATIONS LINE FAILURE, THEFT, DESTRUCTION, OR UNAUTHORIZED ACCESS TO TRACKPADS.COM RECORDS, PROGRAMS, OR SERVICES. IN NO EVENT SHALL TRACKPADS.COM' TOTAL LIABILITY FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AGGREGATE DOLLAR AMOUNT PAID UNDER THE AGREEMENT. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES; AS A RESULT, THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

You acknowledge that Trackpads.com has the right to delete any messages, files, or any other content that you may have uploaded to any service of Trackpads.com which have not been accessed for some period of time and is deemed by Trackpads.com, in its sole discretion, to be abandoned, or any materials that violate the terms of this or any other binding agreement.


VII. External Links

The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because Trackpads.com has no control over such sites and resources, you acknowledge and agree that Trackpads.com is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that Trackpads.com shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.


VIII. Conclusion

a. Modifications

Trackpads.com may, at any time, modify any of the terms and conditions contained in this agreement by posting such changes on Trackpads.com or affiliated websites. If you do not agree to the changes, your only remedy is to cancel your Trackpads.com membership.

b. Governance

This Agreement will be governed by and construed in accordance with the Laws of the State of Texas.

c. Assignability

Trackpads.com may assign this Agreement, or any rights or obligations hereunder, (by operation of law or otherwise) without the prior written consent of its members. This Agreement shall inure to the benefit of, and be binding on, permitted assigns and successors of Trackpads.com.

d. Severability

In the event that any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.

e. Amendments and Waivers

The failure of either Trackpads.com to insist upon or enforce or to exercise any right under this Agreement shall not be construed as a waiver or relinquishment to any extent of Trackpads.com right to assert or rely upon any such provision or right in that or any other instance, and the same shall be and remain in full force and effect. In the event that any published statements, other agreements, or other official policies of Trackpads.com may conflict with any of the terms contained in this document (Terms of Service) the terms of this document shall govern.
