DeLay Could Go to Jail

WASHINGTON — Rep. Tom DeLay will likely be booked in a Texas county jail this week despite attempts by his attorneys to bypass the fingerprinting and mug shot process.

The former House majority leader was forced to step down from the post last month when he was indicted by a Texas grand jury. DeLay initially was charged with conspiracy to violate the election code and days later was indicted on charges of money laundering and conspiracy to launder money in an alleged illegal scheme to funnel corporate money to Republican Texas legislative candidates.

DeLay's arraignment is set for Friday before state district Judge Bob Perkins in Travis County, Texas.

"Perkins believes that if God was charged with a felony, he would have to go through the booking process, too," said D'Ann Underwood, court coordinator for the judge.

Before Friday, DeLay, a Republican from Sugar Land, Texas, will likely spend about an hour being fingerprinted and photographed, she said. He'll also be required to state his attorneys for the record.

Travis County allows some defendants to do a "walkthrough" booking process, in which the defendant is photographed and fingerprinted. But DeLay's bond amount would be preset so he could immediately pay it and avoid a stay in jail.

DeLay also could waive going before a magistrate to have his rights and charges read to him.

At Friday's court appearance, Perkins has the discretion to rule on motions to dismiss the charges, as requested by defense attorneys, but may elect to do so at a later date. The hearing will likely take less than 20 minutes, Underwood said.

Interesting, the presiding judge over DeLay’s case, he’s a Democrat activist. Not only that, the judge is a Moveon.org supporter. DeLay judge supports MoveOn.org

There is a certain procedure for what happens when someone breaks a law - the lawmakers are the last people who should be allowed to skip this process, in my opinion.

If DeLay is innocent, that will still be proved. Meanwhile, due process should be observed.

Absolutely and w/o exception. I don't understand why the crooks and criminals out there should have the full weight of the law come down on them, but those in situations such as DeLay should not. Isn't this the same élitism and "buy their way out" sort of attitude that so many of the moneyed, but non-political, are condemned for? I certainly recall that from the Jackson trial.

If DeLay broke the law, he should pay pay the price, whatever that may be. Let's not sink into all this Liberal vengeance garbage.

I had to go back and find where there was a charge of Lib vengence because I missed it the first time. Here it is:

I guess I'm missing something here, but I don't find it interesting at all or even pertinent to the decision the judge made. Sounds like a good Conservative judge would have made the same ruling, or should have.

It's not but much of what passes as "news" is not even news anymore, just fluff. I am heartened to see some of those who would flout their power like Delay has, and being from Texas he has only been emboldened since Bush took office. He's a crook who should have been indicted a long time ago.

His party notwithstanding, this man sounds like an honest judge. The article makes a point of his party - it's not important. His lack of being impressed with the "great and mighty" is very important.
