Sex law rubs massage therapist wrong way


LINDSTROM, Minn. -- LaRae Lundeen Fjellman could lose her state license as a massage therapist for having sexual relations with her husband.

Her husband, Kirk Fjellman, is a former client. He saw her professionally from October 2000 to May 2002, and the two say they started dating in July 2002.

But when they consumated the relationship a few months later, they ran afoul of a Minnesota law that bans massage therapists from having sexual relations with former clients for two years.

"There's no harm, no victim," Kirk Fjellman said. "What's this about?"

The case is before a judge and could be decided this month, with LaRae Fjellman facing a fine and possibly loss of her license. The outcome could have implications for the private lives of an array of alternative health care providers.

Documents filed by the Department of Health say the therapist clearly violated the state law, passed by the Legislature in 2000. LaRae Fjellman does not deny she violated the statute, but said she didn't know it existed until the state came knocking.

Ridiculous. The law should be amended to make an exception in the case of the parties being married - or getting married before consummation.

The world just gets more and more asinine, and the law contributes to about 95% of it, apparently.

Obviously a very important law, one that has no room for sanity.

Stories like this need to be in the public if for no other reason than to lighten up the news now & then. A peek at some rediculous legal process can have that effect.

Can't help but wonder though how this got into the justice system in the 1st. place. And how much it will cost the couple and the tax payers to process this through the court system.

This is the trouble with electing lawyers as our lawmakers - letting them be politicians by voting them into action. I sound like I'm campaigning against lawyers, don't I! I reckon I am, at that - and a few would be all right, but it seems that lawyers can only support themselves by turning to politics lately, and then they make stupid laws that people somehow discover as money-making deals or to prosecute some innocent people who had no reason to think common sense had been outlawed.

Then, of course, lawyer politicians make new laws, or change those silly ones, thus continuing the farce.
