This type of malfunction can happen with almost any semi-auto weapon. The venerable M1911 .45 auto, carried by US troops from WW1 until after Desert Storm, has on occasion been known to empty its magazine when the slide is let go forward. This is caused by wear to internal components. Only the ATF would consider it as a machine gun.
BATF is a rogue agency that operates on its own agenda with its own rules. They have ignored Congress, the President and the courts on many occasions. They have murdered US citizens and violated Constitutional and Public Law. When there was discussion of moving them under the FBI, the FBI said in no uncertain terms it didn't want them. It's more than past time for them to go away.
