Brian I think that if the getaway driver knew that the persons involved in the actual robbery of a bank were going to kill the guards, than the get away driver should be charged with at least accessory to first degree murder.
However if the driver had no clue than they shouldn't be charged with anything but those charges that are relavant to the actions of the driver.
As for bystanders...they should never be charged (unless they actually took part of the crime by an indirect means ie false statements or what not). If we as a society started to prosecute someone for staning by while a crime was commited in their presence our society will decay into anarchy. I don't expect a father to try to stop a robbery especially if theirs a weapon involved.
Also should a bystander get involved and tries to stop a crime, they should be immune to civil suits should they injure/kill the perpatrator of the crime. Criminal charges however can be levied depending on circumstances. |
